would it matter though? a drawing of a picture... is that copyright infringement?
No. But if it was a photoshop of the original picture of a hand to look like a drawing, then yes.

I don't really care, either way. It still looks bad on their part to so blatantly copy another piece of art like that.

Guys, chilax a bit.

Web sites and artists some times use stock photos that they purchase the rights to use in their products. For instance, the stock photo for Control can also be found as a book cover, I forget what the book is.

This goes on all the time in the graphic design world. Its totally legit and legal.

C=B is correct.

There are tons of stock photos out there. Some are free to use for any purpose (such as clip-art), and some you have to pay a one time fee and you'll have the rights to use it for whatever you want. The same goes for music and video.

Say you came up with a trick called To the Moon and Back. And for the cover of the DVD you wanted a picture of you standing on the surface of the moon. Obviously it would be nearly impossible for you to travel to the moon and take a picture of the surface so you go to these image archives and you look up moon. You pay the artist/photographer (or whoever owns the rights to the image) a fee and now you can use the image for your DVD cover without getting sued.
